Terms of Service

These are the Terms of Service for HeyCaly, an AI-powered WhatsApp customer re-engagement and appointment booking platform. By using HeyCaly, users confirm they are at least 18 years old, represent a legitimate business, and have authority to bind that business to these Terms.

Key points:

  1. Eligibility & Accounts
  • Users must be 18+ and legitimate businesses.
  • Users must provide accurate information, keep credentials secure, and are responsible for all activity under their account.
  1. Services
  • AI-generated personalized WhatsApp messages to past customers.
  • Calendar integration, smart slot filling, appointment booking/confirmation.
  • Analytics dashboard and automated reminders.
  1. User Responsibilities
  • Obtain proper, lawful consent from customers before messaging (GDPR, KVKK, TCPA, etc.).
  • Comply with WhatsApp Business Policy and all messaging laws.
  • Provide accurate business info and not send spam or unlawful content.
  • Honor opt-out requests (e.g., "STOP").
  • Review and take responsibility for AI-generated content.
  1. Subscription, Payments, and Trials
  • Monthly or annual subscriptions, priced in Euros, processed via Stripe.
  • Upgrades are immediate; downgrades apply next billing cycle.
  • Pricing may change with 30 days’ notice.
  • Starter plan: 50 free messages/month with limited features.
  • Paid plans: 14-day free trial, no credit card required; subscription required afterward.
  • Free tier limits may be changed at any time.
  1. Cancellation & Data
  • Users can cancel anytime; no long-term contracts or cancellation fees.
  • Access continues until end of billing period.
  • Data remains accessible for 30 days after cancellation, then is permanently deleted.
  • Immediate data deletion can be requested via support@heycaly.com.
  1. Intellectual Property & AI Content
  • HeyCaly’s platform, brand, code, and design are owned by HeyCaly.
  • AI-generated messages are licensed to the user for business use.
  • Users retain ownership of their business and customer data.
  • Reverse-engineering or redistributing the platform is prohibited.
  • AI outputs are not guaranteed accurate; users are responsible for all messages sent.
  • HeyCaly is a tool; the business is the sender of record.
  1. Data & Privacy
  • HeyCaly processes data as described in its Privacy Policy.
  • The business is the data controller; HeyCaly is the data processor.
  • Customer data is not sold or shared beyond what is necessary to deliver the Services.
  • Upon account deletion, customer data is removed within 30 days.
  1. Service Availability
  • Target uptime is 99.9%, but uninterrupted service is not guaranteed.
  • Scheduled maintenance may occur with prior notice.
  • HeyCaly is not responsible for downtime or issues caused by WhatsApp, calendar providers, payment processors, or other third parties.
  • Message delivery depends on WhatsApp and the recipient’s device/phone status.
  1. Liability & Indemnification
  • HeyCaly’s liability is limited to the amount paid in the 12 months before a claim.
  • No liability for lost revenue, customers, bookings, AI inaccuracies, delivery failures, or third-party outages.
  • Users must indemnify HeyCaly against claims arising from their use of the Services, messages sent, violations of law or these Terms, and failure to obtain proper consent.
  1. Termination
  • HeyCaly may suspend or terminate accounts for Terms or WhatsApp policy violations, spam/fraud, non-payment after notice, or legal requirements.
  1. Governing Law & Changes
  • Governed by the laws of the Republic of Turkey; disputes go first to good-faith negotiation, then to competent courts in Istanbul, Turkey.
  • Terms may be updated; material changes will be emailed. Continued use after changes means acceptance.
